PART 2 — TERMS & CONDITIONS

1. About These Terms

These Terms & Conditions govern the purchase and use of digital courses, videos, audio recordings, vocal exercises, downloadable resources and other educational content provided by MOVO / Mo Brandis (“MOVO”, “we”, “us” or “our”).

By purchasing a MOVO product, you agree to these Terms.

If you do not agree, please do not complete your purchase.

2. Nature of Our Courses and Digital Products

MOVO provides online educational content designed to help singers develop their voices, musicianship, creativity and personal expression.

Our products may include video lessons, guided vocal exercises, audio recordings, backing tracks, meditations, worksheets and downloadable resources.

Unless otherwise stated, courses are self-paced digital products delivered through our online learning platform, currently Kajabi.

Personal coaching, live instruction, individual feedback or medical supervision is not included unless expressly advertised as part of a particular product.

Access is normally provided shortly after successful payment.

You are responsible for maintaining a suitable internet connection and compatible device to access the content.

3. Eligibility

MOVO courses are primarily intended for adults aged 18 and over.

Participants under 18 should have permission and appropriate supervision from a parent or legal guardian.

All participants are expected to follow the course instructions responsibly and practise within their individual physical limits.

4. Vocal Health and Safety

Educational Purposes Only

All MOVO courses, exercises and materials are provided for educational purposes only.

They do not constitute medical advice, diagnosis, treatment, speech therapy or vocal rehabilitation and are not a substitute for professional medical guidance.

Practise Responsibly

Vocal exercises should always be performed gently, carefully and within your comfortable range.

You should never force your voice or attempt to achieve a particular sound through excessive effort.

Stop if Discomfort Occurs

You must stop practising immediately if you experience:

– Pain or vocal strain

– Hoarseness or unusual vocal changes

– Discomfort or vocal fatigue

– Any other concerning physical symptoms

Do not push through discomfort.

If symptoms persist or recur, seek advice from a qualified medical or vocal health professional before continuing.

Existing Medical Conditions

If you have a known vocal injury, existing voice disorder, relevant medical condition or are recovering from illness or surgery, you should seek appropriate professional advice before beginning vocal exercises.

You are responsible for following the guidance carefully and respecting your individual limitations.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

5. No Guarantee of Results

Every voice is unique, and individual progress varies.

MOVO does not guarantee specific improvements in vocal range, tone, strength, confidence, technique or performance ability.

Results depend on several factors, including individual anatomy, health, experience, consistency and practice habits.

Testimonials and demonstrations reflect individual experiences and should not be interpreted as guaranteed outcomes.

Your statutory rights concerning the quality and conformity of purchased digital products remain unaffected.

6. Intellectual Property and Copyright

All original MOVO course materials, including videos, audio recordings, exercises, backing tracks, written resources, graphics and other educational content, are owned by Mo Brandis or used with permission from their respective rights holders.

Purchasing a product grants you a limited, non-exclusive, non-transferable licence to use the content for your own personal learning and practice during the applicable access period.

Purchasing a product does not transfer ownership or copyright.

You may not, without prior written permission:

– Share your account or login details with others

– Copy, reproduce, distribute or resell course materials

– Upload MOVO content to social media or file-sharing platforms

– Share course materials with other individuals, students, choirs, schools or groups

– Use MOVO course materials or recordings for commercial teaching or training

– Record, screen-capture or download protected content unless explicitly permitted

– Repackage or incorporate MOVO materials into another course or commercial product

Where downloadable resources are expressly provided, they may be downloaded and used within the permitted personal-use licence.

These restrictions do not prevent you from applying the knowledge and skills you learn to your own singing, performances or musical development, or from exercising rights permitted by law.

Unauthorised use may result in suspension or termination of access and further action where legally appropriate.

7. Payment Terms and Payment Plans

Prices, currencies and applicable taxes are displayed at checkout.

MOVO products may be offered through a single payment or a fixed payment plan.

Where a fixed payment plan is offered, the number of instalments, individual payment amounts, total purchase price and payment frequency will be communicated before purchase.

By choosing a payment plan, you agree to pay the full agreed purchase price according to the stated schedule, subject to applicable statutory rights.

A fixed payment plan is not a monthly subscription unless expressly described as such. Discontinuing your personal use of the course does not automatically cancel outstanding instalments.

Payments are processed through the payment providers available at checkout.

If a payment fails, we or our payment processor may attempt to collect it again or contact you to update your payment information.

Access may be temporarily suspended for unresolved overdue payments, following appropriate notice and where permitted by law.

No additional payment penalties will be imposed unless legally permitted.

8. Course Access and Availability

The access duration for each product will be stated at the time of purchase.

Some products may include a fixed access period, while others may be advertised with lifetime access.

Where lifetime access is expressly offered, it applies to the purchased product and does not automatically include future courses, separately sold materials or personal coaching.

Your agreed access rights and applicable statutory protections remain unaffected.

We may update or improve course content, restructure lessons or change the technical platform used to deliver our products.

We aim to provide reliable access but cannot guarantee that the platform will be available without interruption at all times.

Temporary maintenance, technical problems or third-party outages may occasionally affect availability.

We will make reasonable efforts to resolve problems within our control.

Your statutory rights remain unaffected if a purchased digital product is not supplied or does not meet the applicable legal requirements.

9. Digital Content, Cancellation and Refunds

Under applicable consumer law, customers purchasing digital products online may have a statutory 14-day right of withdrawal.

For qualifying digital content not supplied on a physical medium, this right may expire once the supply of content begins, provided that the relevant legal requirements have been fulfilled.

These include:

– Your express consent to receive digital content before the end of the statutory withdrawal period

– Your acknowledgement that your statutory withdrawal right will be lost once supply begins

– MOVO providing the legally required purchase confirmation

Where these requirements have not been validly fulfilled, your statutory withdrawal rights remain unaffected.

Different rules may apply to other types of products or services.

Refund Policy

Once the applicable statutory withdrawal right has validly expired, MOVO does not ordinarily provide refunds for change of mind, lack of use or dissatisfaction, unless a separate refund guarantee has been expressly offered with the product.

Any such guarantee will be subject to the conditions communicated with that offer.

This does not affect your statutory consumer rights, including remedies for defective, inaccessible or incorrectly supplied digital products.

10. Suspension or Termination

MOVO reserves the right to suspend or terminate access in the event of serious misuse, unauthorised account sharing, copyright infringement, fraud or other substantial breaches of these Terms.

Where appropriate, we will provide notice and an opportunity to resolve the issue before taking action.

Any suspension or termination will be proportionate and subject to applicable law.

Your statutory rights remain unaffected.

11. Limitation of Liability

MOVO provides educational content intended to be followed carefully and responsibly.

We are not responsible for the consequences of exercises being performed contrary to clearly communicated safety instructions, except where liability nevertheless arises under applicable law.

Nothing in these Terms limits or excludes liability for intentional misconduct, gross negligence, or injury to life, body or health resulting from negligent or intentional breaches of duty.

In cases of slight negligence involving essential contractual obligations, liability may be limited to foreseeable damage typical of the contract, where permitted by law.

In other cases of slight negligence, liability is excluded to the extent permitted by law.

Nothing in these Terms restricts mandatory statutory consumer rights.

12. Privacy and Personal Data

MOVO processes personal information in connection with purchases, account creation, course access, payments and customer support.

Our digital products are currently delivered through Kajabi, and payment processing may involve third-party providers.

Further information about the collection, use and protection of personal data is provided in our separate Privacy Policy.

13. Changes to These Terms

MOVO may update these Terms from time to time to reflect changes in our products, services, business operations or applicable law.

The Terms agreed at the time of purchase will ordinarily apply to that purchase.

Changes will not unlawfully reduce existing contractual or statutory rights.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

Where consumers reside in another country, this choice of law does not deprive them of mandatory consumer protections applicable under relevant law.

Any disputes will be handled in accordance with applicable jurisdiction rules.
